AMLD6 (Sixth Anti-Money Laundering Directive)

Definition

AMLD6 is Directive (EU) 2024/1640, the institutional layer of the EU’s 2024 AML package. It governs national supervisors, financial intelligence unit powers and beneficial-ownership registers, and must be transposed by each member state — in general by 10 July 2027, with register provisions applying on an earlier, staggered timetable.

What is AMLD6?

AMLD6 — Directive (EU) 2024/1640 — is one of the three instruments in the EU's 2024 anti-money-laundering package, alongside the AMLR (the directly applicable single rulebook) and the AMLAR (which created AMLA in Frankfurt). Where the AMLR tells firms what to do, AMLD6 tells member states how to organise the machinery around them: national supervisors, the powers of financial intelligence units, beneficial-ownership registers, and cross-border cooperation.

Because it is a directive, Ireland must transpose it into Irish law. The general transposition deadline is 10 July 2027, but the beneficial-ownership register provisions are staggered earlier: register access rules applied from 10 July 2025, and the core register articles plus their technical standards from 10 July 2026.

Why does AMLD6 matter for Irish firms?

Most of AMLD6 is addressed to the State rather than to firms, but its effects are very practical:

  • It reshapes how Ireland's sector supervisors — the Central Bank, the Law Society, the designated accountancy bodies, the PSRA and the AMLCU — supervise and sanction designated persons.
  • It strengthens FIU Ireland's powers and the framework for suspicious transaction reporting.
  • It upgrades beneficial-ownership registers such as the RBO and CRBOT, giving registrars new verification powers and connecting registers EU-wide through the BORIS interconnection system.
  • It frames who can access BO registers after the CJEU's 2022 privacy ruling — including the legitimate-interest access that designated persons rely on.

How does AMLD6 fit with the AMLR?

Think of it as a division of labour: the AMLR sets the obligations that land directly on obliged entities from 10 July 2027; AMLD6 builds the supervisory and register infrastructure those obligations depend on. Irish transposition choices through 2026–27 will decide the local detail, so firms should watch Department of Justice and supervisor guidance rather than assume the CJA 2010 status quo carries over unchanged.
